Terms of Service

Curate (“we,” “us”) is a social platform for discovering, rating, and reviewing music. These Terms of Service (“Terms”) are a binding agreement between you and Curate that governs your access to and use of the Curate website, mobile apps, and related services (together, the “Service”). Please read them carefully.

Acceptance of these terms

By creating an account, or by accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

Accounts and eligibility

  • You must be at least 13 years old to use Curate. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.
  • You are responsible for the activity that happens under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use.
  • The information you provide when you register must be accurate, and you agree to keep it up to date.

Your content

Curate lets you post content — ratings, reviews, lists, comments, avatars, usernames, and other material (“User Content”). You retain ownership of your User Content.

By posting User Content, you grant Curate a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content solely to operate, provide, and promote the Service. This license ends when you delete your User Content or your account, except for content others have shared or that we must retain to comply with the law. You represent that you have the rights necessary to post your User Content and to grant this license.

Acceptable use

You agree not to:

  • Harass, threaten, bully, or harm others, or post hateful or abusive content.
  • Post spam, scams, or misleading or deceptive content.
  • Infringe anyone’s intellectual property, privacy, or other rights.
  • Post content that is unlawful, obscene, or sexually exploitative, or that promotes violence or illegal activity.
  • Impersonate any person or entity, or misrepresent your affiliation with anyone.
  • Attempt to access accounts or data that are not yours, disrupt the Service, or circumvent its security or rate limits.
  • Scrape, crawl, or harvest data from the Service except as expressly permitted.

Moderation and termination

We may review, remove, or restrict content that violates these Terms or that we reasonably believe is harmful, and we may suspend or terminate accounts that do so. You may stop using the Service and delete your account at any time. We may also suspend or end the Service, or your access to it, where necessary to protect Curate, our users, or to comply with the law.

Third-party services

The Service integrates with third-party providers. When you connect a service or view catalog data, you are also subject to that provider’s terms. In particular, music metadata and artwork are provided by Spotify through the Spotify Platform; that content is owned by Spotify or its licensors, and your use of it is governed by Spotify’s terms. Curate is not sponsored by or affiliated with Spotify.

We are not responsible for third-party services and do not endorse them.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content is accurate.

Limitation of liability

To the fullest extent permitted by law, Curate and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the “Effective date” above and, where appropriate, notify you in the product. Your continued use of the Service after changes take effect means you accept the revised Terms.

Governing law

These Terms are governed by the laws of [governing jurisdiction to be determined], without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in that jurisdiction, unless applicable law provides otherwise.
